This course explores the legal and ethical parameters of the Standard of Care, Scope of Practice, Scope of Competence, Therapeutic Duty, Informed Consent, and Confidentiality. Topics include: appropriate assessment, diagnosis, and treatment considerations, and management of crisis issues. Relevant examples from malpractice suits, Board of Behavioral Sciences (BBS) administrative cases, and sections from the NASW Code of Ethics are used to exemplify appropriate and reasonable clinical behavior.The author and NASW-CA recommend that readers seek individual consultation with an attorney prior to making legal decisions affecting his or her practice. License Requirement: The course content meets the California license renewal requirement for Licensed Clinical Social Workers (LCSWs) and Marriage Family Therapist (MFTs), who must complete six continuing education units in the subject of Law and Ethics every renewal beginning with the first renewal falling on or after January 1, 2004. Objectives: |
- Registrants will gain a better understanding of California Law, the NASW Code of Ethics, and the California Business and Professions Code as they apply to LCSWs.
- Registrants will review key elements of confidentiality such as mandated and permitted breaches along with important elements regarding Release of Information.
- Registrants will review legal concepts such as Scope of Practice, Therapeutic Duty, Standard of Care, and Informed Consent.
- Registrants will review the critical aspects of developing safety with the therapeutic relationship as well as how to best manage crisis situations.
