Course Description:

This course addresses high risk and crisis issues from the perspective of a Board Certified Forensic Expert (BCFE) who is retained by attorneys to help defend or litigate cases against clinicians involved in a malpractice or administrative action. This perspective is extremely beneficial to clinicians because it is based on actual court cases and not on theoretical models. It is important to point out from the beginning that the author and NASW strongly recommend that readers seek individual consultation with an attorney prior to making any legal decisions affecting their clinical practice. This course is not intended to provide legal advice and, in the event of a malpractice suit, clinicians should always consult with an attorney who specializes in such cases.

Course topics and examples explore and demonstrate the legal, ethical, and clinical Standard of Care for California LCSWs and MFTs. Utilizing California law, Case Law, and the NASW Code of Ethics the author describes how to provide what is defined as reasonable and prudent care along with how to avoid devastating legal and professional consequences. When clinicians manage high risk or crisis issues below the Standard of Care, they open themselves to damaging malpractice and/or administrative actions and, in some cases, an accusation of contributing to the wrongful death of the client and/or others. Obviously, if unmanaged or managed poorly, these situations can lead to severe physical and emotional harm to clients, their families, and other victims.

Law and Ethics Requirement

This course meets the California license renewal requirement for content in law and ethics. The requirement for California LCSWs and MFTs is that they obtain six (6) hours of law and ethics every license renewal after January 1, 2004. Target Audience: This course is appropriate for all clinicians but it was specifically created for seasoned therapists. Since high risk situations and crisis issues are impossible to predict, every clinician is expected to have the training, knowledge, and experience to appropriately address these issues according to the Standard of Care. This course explores the therapeutic responsibility, legal and ethical therapeutic duties, clinical management of high risk and crisis issues, and the appropriate documentation for creating clinical safety for the client, the clinician, and the therapeutic relationship. This content can serve as an excellent reference and resource guide to therapists now and in the future.

 

Learning Objectives:

In relation to managing crisis issues within the therapeutic relationship, the reader will:

  1. Explore and learn to better apply legal, ethical, and clinical Standard of Care.


  2. Improve their Scope of Competence.


  3. Learn to apply important California law and Case Law.


  4. Learn to apply applicable NASW and CAMFT ethical standards.


  5. Better understand the importance in appropriately documenting assessments, diagnoses, and treatments.


  6. Better recognize inherent risk factors associated with high risk behavior and crisis issues.


  7. Be able to create and apply an appropriate treatment plan.


  8. Better understand the definition of prudent and reasonable action and documentation.


  9. Better understand what expert witnesses and attorneys look for in a malpractice suit.


  10. Read case vignettes describing real cases where the author served as an expert witness.
